1. Acceptance of Terms
By accessing or using Markwork ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Markwork is an AI-powered tool that provides automated feedback on academic assignments. You upload a document, and the Service returns a grade estimate, strengths, weaknesses, and improvement suggestions generated by an artificial intelligence model.
The feedback provided is for learning and self-assessment purposes only. It is not an official university grade, and should not be treated as one. Markwork is not affiliated with any university or educational institution.
3. Eligibility
The Service is intended for university and higher-education students aged 16 or older. By using the Service, you confirm that you meet this age requirement.
4. Acceptable Use
You agree to use the Service only for its intended purpose — receiving AI feedback on your own academic work. You must not:
- Upload files that contain malware, viruses, or malicious code.
- Upload content that is illegal, defamatory, or violates the rights of others.
- Attempt to bypass rate limits, reverse-engineer the Service, or access other users' data.
- Use the Service to generate content intended to be submitted as your own work without proper academic integrity (i.e., do not use AI-generated feedback to plagiarise).
- Use automated tools, bots, or scripts to make bulk submissions.
- Upload files containing sensitive personal data unrelated to your assignment (e.g., financial records, medical data).
5. Intellectual Property
Your content: You retain full ownership of any files you upload. By submitting a file, you grant Markwork a temporary, limited licence to process the file solely for the purpose of generating feedback. This licence expires when your submission is deleted.
Our content: The Markwork name, logo, interface design, and underlying code are the intellectual property of Markwork. You may not copy, reproduce, or redistribute any part of the Service.
AI-generated feedback: The feedback generated by the Service is provided to you for personal use. You may save, share, or reference it as you wish, but it comes with no guarantee of accuracy (see Disclaimer below).
6. Data Handling
Your data is handled as described in our Privacy Policy. Key points:
- Files are stored temporarily and automatically deleted after the expiry period (default: 7 days).
- We do not sell or share your files with third parties beyond AI processing.
- No account or personal information is required to use the Service.
- IP addresses are hashed and never stored in raw form.
7. Rate Limits
To ensure fair access for all users, the Service enforces submission limits per IP address within a rolling time window. If you exceed the limit, you will need to wait before submitting again. The specific limits may change without notice.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, either express or implied.
- Accuracy: AI-generated grades and feedback are estimates only. They may not reflect the grade your university would assign. Do not rely on Markwork as a definitive assessment of your work.
- Availability: We do not guarantee uninterrupted access to the Service. Maintenance, updates, or technical issues may cause temporary downtime.
- Completeness: The AI may miss errors, misinterpret content, or provide feedback that is incomplete or incorrect. Always apply your own judgement.
9. Limitation of Liability
To the maximum extent permitted by law, Markwork and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to:
- Academic outcomes influenced by reliance on AI feedback.
- Loss of data or files.
- Inaccurate grades or feedback.
- Service downtime or unavailability.
Our total liability for any claim arising from the Service shall not exceed the amount you paid to use the Service (which, for the free tier, is zero).
10. Academic Integrity
Markwork is a learning tool, not a shortcut. You are responsible for ensuring that your use of this Service complies with your university's academic integrity policies. Using AI feedback to improve your understanding of your work is encouraged. Misrepresenting AI-generated content as your own original analysis is not.
11. Termination
We reserve the right to block access to the Service for any user who violates these terms, abuses the system, or uses the Service in a way that negatively affects other users. No prior notice is required.
12. Changes to These Terms
We may update these terms from time to time. Changes will be reflected on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
13. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
